TSCA Risk Evaluation and Regulatory Issues: Do You Feel Me Now?
The Environmental Protection Agency’s (EPA) implementation of the 2016 amendments to the Toxic Substances Control Act (TSCA) is in full swing and every portion of the chemical value chain can feel the impacts. Suppliers and manufacturers of consumer products need to be especially mindful of when and how EPA is selecting and prioritizing existing chemicals for risk evaluation and managing the legal, regulatory, and commercial implications of these evaluations. This presentation focuses on the commercial realities of industrial chemical evaluation and how best to anticipate, manage, and optimize the implications of new TSCA.

    The New York State Department of Environmental Conservation (NYSDEC) recently finalized their burdensome and contradictory 2018 ingredient communication guidance document. In response, HCPA has partnered with the American Cleaning Institute (ACI) and law firm Whiteman Osterman Hanna, LLP to challenge this policy in the courts. This new year has brought about unexpected hurdles and delays, but our case remains strong, and we will continue to move forward by remaining flexible and driven.

Section 232 tariffs on imported steel and aluminum, and Section 301 tariffs on Chinese imports have forced many manufacturers to make rapid changes to their supply chains. Retail Engagement Special Session
Retailers’ chemical policies continue to have a significant influence on HCPA members. Lowe’s recently implemented its safer chemicals policy through a number of strategic actions and commitments. The Supplier Ingredient Reporting (SIR) Work Group, an industry consortium, is leading suppliers’ actions to make practical operational improvements in the third-party, computer-based system that retailers rely on to implement their chemical policies. The “Mind the Store” campaign and its annual report card provide a powerful incentive for retailers to adopt and enhance chemical policies.

The ADBAC/DDAC Issue Steering Committee is a joint venture comprised of chemical manufacturers focused on the compilation, development and acquisition of any new information regarding commercial species of ADBAC/DDAC products. These efforts aim to satisfy U.S. Federal, U.S. State, European Union (“EU”), or other foreign or international regulatory requirements. These efforts are in support of the marketing of biocidal products and other related advocacy related activities such as education, communications and public relations.

Ignite Solutions Antimicrobial Exposure Assessment Joint Venture
The Antimicrobial Exposure Assessment Joint Venture was formed for the exclusive purposes of owning and asserting rights in the information compiled, developed, or otherwise acquired in anticipation of EPA and other foreign jurisdictions making registration and re-registration decisions regarding antimicrobials and their exposure potential from residential, industrial and institutional applications.

Ignite Solutions Plastic Aerosol Research Group (PARG)

The Plastic Aerosol Research Group, LLC. (PARG) is an internationally recognized consortium actively involved in the global advancement of the aerosol industry. PARG is an advocate to the expansion of the aerosol container platform in an effort to grow the aerosol industry as a whole through good science and innovative processes. Founded in 2011, PARG works in close conjunction with the Household and Commercial Products Association (HCPA) and members include brand-owners, co-packers, and suppliers including packaging, valves, propellant and equipment.

Ignite Solutions Quats Residue Group

The Quats Residue Group scope of work encompasses, but is not limited to, the quantification of quat residues on various surfaces left by various application methods. The group also engages with regulatory authorities to assist with the update of risk assessment methodologies, ensuring that the most relevant and accurate science is being utilized to ensure public safety.

Ignite Solutions Efficacy Task Force
Location: HCPA Office, 1667 K St NW, Washington, DC

The Efficacy Task Force, LLC (ETF) is a group of companies that have come together to determine whether data bridging documents will satisfy EPA efficacy data gap requirements for reregistration of a number of active ingredients. The group is also looking into developing protocols for the development of Data to support products for public health uses of invertebrate control agents intended to control certain pests. The ETF also engages with advocacy before the EPA, State and local governments, as appropriate, in support of registration, sale, distribution and use of products.

Ignite Solutions Lawn and Horticultural Products Work Group (LHPWG)

The Lawn and Horticultural Products Work Group (LHPWG) is a member driven consortium comprised of industry leaders in the lawn and horticultural markets. The LHPWG’s vision is to promote the implementation and administration of science-based laws and regulations affecting the sale, distribution and use of lawn and horticultural products in a manner that advocates environmental stewardship while preserving the ability of member companies engaged in this industry to operate efficiently, effectively, and productively.
